This page will provide the most current Yaz lawsuit information concerning the lawsuits alleging an increased risk of VTE’s associated with this type of fourth generation birth control pill, including Yaz pulmonary embolism, deep vein thrombosis, stroke, and heart attack information.
In their February 2013 annual financial report, the German pharmaceutical company, Bayer, stated that they had reached agreements to settle lawsuits from 4,800 plaintiffs in the amount of nearly $1 billion. According to the report, there are still over 13,000 claimants with lawsuits pending allegedly from side effects sustained while taking the oral contraceptives Yaz and Yasmin.
Generic Versions of Yaz & Yasmin – Ocella, Safyral, Gianvi
According to reports as of May, 2013 cases involving the generic versions of Yaz including Ocella, Safyral, and Gianvi are now settling for women who endured a VTE event. Due to the United States Supreme Court ruling of Mensing liability of the original manufacturer for generic products is a hotly contested issue. Settlements for thrombotic events like deep vein thrombosis (DVT), Pulmonary Embolisms (PE’s), Strokes, Heart Attacks and Death are the right avenue to proceed on to try to provide compensation for women who were injured by even the generic products.
Similar to the hotly contested generic liability for Ocella, Safyral and Gianvi, Bayer initially resisted settlements for any BeYaz cases, but according to reports as of May, 2013, Beyaz blood clots cases, including, DVT, PE, may be eligible for settlement.
Gall Bladder Cases
Bayer denies any liability for gall bladder issues, but has settled the cases in a quasi-class action manner. Bayer has set aside roughly 24 million dollars for a fund for women who have had their gall bladders removed. The maximum compensation per woman in the gall bladder settlement is $3,000 with a possible proration depending on how many women opt in to the settlement fund. As of May, 2013 our firm can no longer accept any Gall Bladder cases but we would still discuss your case and your rights with you if you call.
Yaz Settlement Amounts
One of the most common and understandable questions individuals wonder is how much their case is worth or how much compensation they can expect to obtain? As lawyers we strive to be candid with our clients and our predictions and don’t want to impart any false expectations or dehumanize the case and just speak about it economically, but since it is a common question, here is a somewhat clinical answer.
Each individual woman will have particularized damages based on a variety of factors that may include hospitalization, BMI, smoking history, family history, genetic issues, course of treatment, age, and many other factors. It was initially reported that the average settlement was approximately $200,000 but that figure can vary wildly depending on the assortment of criteria. If there is death related to Yaz, Yasmin, Ocella, Gianvi, Safyral, or Beyaz, no amount of money can bring a loved one back and it’s tragic to even think about justice in terms of remuneration. However, Bayer will not say they are sorry, admit liability or say that they did anything wrong, but they may settle the case economically.
